Alabama employers follow federal OSHA recordkeeping and add the Workers' Compensation Act's record and report (Code of Ala. 25-5-4, with the Department's rule 480-5-1-.01): a WCC 2 Employer's First Report of Injury within 15 days for a death, a permanent disability or more than three days of disability. Here is each Alabama rule with a link to the Code of Alabama or the Administrative Code, and what an Alabama incident report should record.

What Alabama requires

  • An employer keeps a record of all injuries, fatal or otherwise, that its employees receive arising out of and in the course of their employment and for which compensation is claimed or paidCode of Ala. 25-5-4
  • Within 15 days after the injury and the employer's knowledge of it, a report goes to the Department on its approved form: the WCC 2 Employer's First Report of Injury, for every injury for which compensation is claimed or paid, including deaths, permanent disabilities and temporary disabilities of more than three daysCode of Ala. 25-5-4 ยท Ala. Admin. Code 480-5-1-.01 (1)
  • The insurer or self-insured employer files a WCC 3 Supplementary Report within 10 days after the first payment of compensation, after 30 days of nonpayment once the employer knows of a claim, or after payments stop, and a WCC 4 Final Report within 10 days (30 at most) after the final payment; incomplete or illegible reports are not acceptedAla. Admin. Code 480-5-1-.01 (2), (3), (5)
  • The injured employee or a representative gives the employer written notice of the accident within five days; without it, medical fees and accrued compensation are lost unless incapacity, fraud, deceit or equally good reason prevented notice, and no compensation is payable at all without written notice within 90 daysCode of Ala. 25-5-78
  • The notice is served personally or by registered or certified mail and follows the statutory form: who was injured, where they worked, their job, under whose superintendency, the date and hour, where the employee now is, the nature of the injury as far as known, signed with an address and datedCode of Ala. 25-5-79
  • A claim for an injury not caused by cumulative physical stress is barred unless, within two years after the accident, the parties agree on compensation or one of them files a verified complaint; payments of compensation restart the period from the last paymentCode of Ala. 25-5-80

The record and the WCC 2, within 15 days

Keep a record of every work injury for which compensation is claimed or paid. Within 15 days after the injury and your knowledge of it, the WCC 2 Employer's First Report of Injury goes to the Department, usually through your insurer. It covers deaths, permanent disabilities and temporary disabilities of more than three days. The Department now sits within the Alabama Department of Workforce.

Later reports

Your insurer, or you if self-insured, follows up with a WCC 3 Supplementary Report within 10 days of the first payment, of 30 days without payment, or of payments stopping, and a WCC 4 Final Report after the last payment. The Department rejects incomplete or illegible reports.

The employee's written notice

The injured employee gives you written notice within five days of the accident, in person or by registered or certified mail. The law's form names the injured employee, the workplace, the job, who they worked under, the date and hour, where the employee is now and the nature of the injury, signed and dated. Without notice in five days the employee can lose medical fees and accrued compensation, and without it in 90 days, all compensation.

Claims are barred two years after the accident unless the parties agree or one of them files a verified complaint.

From field notes to a finished Alabama report

Note the date, hour and place, the employee's job and supervisor, the nature of the injury, and each day of disability. ReportDraft writes the incident up and keeps fields for the written notice date, the days of disability and the WCC 2.

Common mistakes

  • Not sending the WCC 2 once disability passes three days.
  • Not recording when the employee's written notice arrived.
  • Leaving the employee's supervisor off the report.
  • Keeping no record of claimed injuries that were never paid.
  • Sending an incomplete or illegible report.
