Arizona employers follow federal OSHA recordkeeping and add the Workers' Compensation Act's reports (A.R.S. 23-908): every known work injury needing medical treatment is reported to your carrier and the Industrial Commission, within ten days of notice, and the injured employee gets your insurer's details right away. Here is each Arizona rule with a link to the Arizona Revised Statutes, and what an Arizona incident report should record.

What Arizona requires

  • Every employer under the Act files with the Industrial Commission and its insurance carrier a full and complete report of every known work injury that results in death or requires medical treatment, in the form and detail the Commission prescribes; medical treatment does not include one-time, short-term treatment by nonmedical staff, such as care for minor scratches, cuts, burns and splintersA.R.S. 23-908 (A)
  • Within ten days after receiving notice of an accident, the employer informs its insurance carrier and the Commission on the Commission's formsA.R.S. 23-908 (G)
  • Immediately on notice of an accident that injures an employee, the employer gives the employee the name and address of its insurance carrier, the policy number and the expiration dateA.R.S. 23-908 (H)
  • The injured employee reports the accident and the injury to the employer forthwith, and the employee's own physician reports to the employer, the carrier and the Commission; the employer may designate in writing a physician for one examination; if the accident is not reported forthwith, or the employee joins in refusing the examination, no compensation is paid unless the Commission excuses the failureA.R.S. 23-908 (E), (F)
  • Anyone failing or refusing to comply with these reporting duties is guilty of a petty offenseA.R.S. 23-908 (J)
  • A compensation claim is valid only if filed with the Commission in writing within one year after the injury becomes manifest or the claimant should know of it, unless the employer or carrier has started paying compensation; when the Commission is notified of an injury, it sends the employee a claim formA.R.S. 23-1061 (A), (B), (C)
  • Every employer keeps posted in a conspicuous place on its premises, in English and Spanish, the statutory notice that employees are deemed to accept the compensation law unless they reject it in writing before any injury, with the rejection forms available where employees are hired; without the notice or the forms, employees hired in that period may sue insteadA.R.S. 23-906 (D), (E)

Which injuries you report

Report every known work injury that causes a death or needs medical treatment. Medical treatment does not include one-time, short-term care by nonmedical staff, such as cleaning a minor scratch, cut, burn or splinter. Stitches at an urgent care or a prescription counts.

Ten days to the carrier and the Commission

Within ten days after you get notice of an accident, inform your insurance carrier and the Industrial Commission on the Commission's forms. As soon as you learn an employee was hurt, give them your carrier's name and address, the policy number and its expiration date. Failing to comply is a petty offense.

The employee's report and the claim

Injured employees report the accident to you right away; without a prompt report, compensation can be lost unless the Commission excuses it. You may designate a physician for one examination. The employee's claim is filed with the Commission within one year, and the Commission sends a claim form when it hears of an injury.

The English and Spanish notice

Keep the statutory notice posted in English and Spanish where employees can see it, and keep the forms for rejecting the compensation law available where you hire. Without them, employees hired while they were missing may sue instead of taking compensation.

From field notes to a finished Arizona report

Note the date, time and place, how it happened, what care was given and by whom, and when you gave the employee your insurer's details. ReportDraft writes the incident up and keeps fields for the treatment, the insurer information and the report date.

Common mistakes

  • Treating stitches at urgent care as first aid.
  • Not giving the employee the insurer's name, policy number and expiry right away.
  • Missing the ten days to the carrier and the Commission.
  • An English-only notice.
  • No rejection forms where employees are hired.
