Arkansas employers follow federal OSHA recordkeeping and add the Workers' Compensation Commission's rules (AWCC Rules 099.07 and 099.08): every injury goes in your record, and a death, more than seven days of lost time or a permanent disability is reported within ten days through your carrier. Here is each Arkansas rule with a link to the Commission's rules, and what an Arkansas incident report should record.

Code Ann. 11-9-529 (a))
  • All other injuries are reported monthly on the Commission's form as totals: the number of injuries, time lost, medical amounts and the nature of the injuriesAWCC Rule 099.08
  • Claims filed with the Commission include those with more than seven days of disability and controverted medical-only claims; every box on a Commission form is completed, and a form with missing, incomplete or inaccurate information may be rejected and treated as not filedAWCC Rule 099.39 (I) (A)
  • Every employer under the Act keeps the Commission's required notice (Form P) posted on substantial material in a conspicuous place in and about each place of business; an employer using certified managed care also posts the managed care notice (Form H)AWCC Rule 099.07 ยท AWCC Rule 099.33
  • The Commission tells injured employees to report the injury to the employer or supervisor immediately, however slight, and to give written notice of its time, place and nature with enough detail for the employer to arrange treatment and complete its reports; the employer or insurer should give the employee a copy of their rights to medical care (Form AR-N)AWCC: Arkansas Workers' Compensation Questions and Answers

Every injury recorded, the serious ones reported in 10 days

Keep a record of every injury, however minor, and show it to the Commission if it asks. Report deaths, injuries with more than seven days of lost time, and injuries where compensation is due for permanent disability within ten days. Unless you are self-insured, you report through your carrier. Other injuries are reported monthly as totals.

Complete forms only

Claims with more than seven days of disability are filed with the Commission. Every box on a Commission form must be completed. A form with missing or inaccurate information can be rejected and counted as never filed.

The poster, the employee's notice and Form AR-N

Keep the Commission's Form P notice posted at every place of business, and the Form H notice too if you use certified managed care. The Commission tells employees to report every injury right away, however slight, with written notice of the time, place and nature. You or your insurer should give the employee Form AR-N, which explains their rights to medical care.

From field notes to a finished Arkansas report

Note the time, place and nature of the injury, how it happened, and each day lost. ReportDraft writes the incident up and keeps fields for the written notice, Form AR-N, the lost time and the report to your carrier.

Common mistakes

  • Leaving minor injuries out of the record.
  • Missing the ten-day report once lost time passes seven days.
  • Sending a report with blank boxes.
  • Not giving the employee Form AR-N.
  • No Form P notice at a second location.
