What Idaho requires
- As soon as practicable and no later than ten days after an injury or occupational disease that requires treatment by a physician or causes absence from work for one day or more, the employer reports it in writing to the Industrial Commission on the Commission's form; mailing it within the time counts as complianceIdaho Code 72-602 (1)
- If the disability lasts beyond sixty days, the employer files a supplemental report with the Commission at the end of that period, on the Commission's form, that the employee is still disabledIdaho Code 72-602 (2)
- When the disability ends, the employer files a final supplemental report, and the employer or other party liable files a summary of the total compensation paid or payable, as the Commission prescribesIdaho Code 72-602 (3), (4)
- An employer who willfully fails or refuses to make any of these reports is guilty of a misdemeanorIdaho Code 72-602 (5)
- A claim cannot proceed unless notice of the accident was given to the employer as soon as practicable and no later than sixty days after it, and a claim for compensation is made within one year of the accident (or of a death), unless compensation was paid voluntarily or a hearing was requestedIdaho Code 72-701
The first report, within 10 days
If an injury or occupational disease needs a physician's treatment or keeps the employee off work for a day or more, report it in writing to the Industrial Commission on its form as soon as practicable and no later than ten days after it happened. Mailing it within the ten days counts.
Long disabilities
If the disability passes sixty days, file a supplemental report saying the employee is still disabled, then a final report when it ends, and a summary of the compensation and medical payments as the Commission prescribes. Willfully skipping any of these reports is a misdemeanor.
The employee's notice
Employees give notice of the accident as soon as practicable and within sixty days, and claim compensation within one year.
From field notes to a finished Idaho report
Note what happened, whether a physician treated the employee, and any days off. ReportDraft writes the incident up and keeps fields for the treatment, the days absent and the date the first report went to the Commission.
Common mistakes
- Not reporting an injury that needed a doctor because the employee did not miss work.
- Missing the ten-day window.
- No supplemental report once a disability passes sixty days.
- Forgetting the final report when the employee returns.
- Assuming the insurer's file replaces the employer's report.
