Oklahoma employers follow federal OSHA recordkeeping and add the Workers' Compensation Commission's First Notice of Injury (OAC 810:10-1-4): within ten days for a death, lost time beyond the shift, or medical care away from the work site. Here is each Oklahoma rule with a link to the Oklahoma Administrative Code or the Commission's own notice, and what an Oklahoma incident report should record.

  • A claim for an accidental injury is filed with the Commission within one year of the injury, or six months after the last benefits; a death claim within two years of the death; an occupational disease claim within two years of the last injurious exposure; a cumulative trauma claim within one yearCC-Form 1A (law effective 2019-05-28)
  • Within ten days after the First Notice of Injury is filed, the injured worker is mailed notice of the Commission's counselor program and of mediation and other dispute resolutionOAC 810:10-3-3 (c)

The First Notice of Injury, within 10 days

Within ten days after you learn of a death, or of an injury that costs time beyond the shift or needs medical care away from the work site, the Commission gets a First Notice of Injury: a CC-Form-2 from you, or a First Report of Injury your claim administrator files electronically. A trip to an urgent care or ER counts even if the employee is back the next shift.

Care, controversion and the counselor notice

Provide immediate first aid and the medical care the injury reasonably needs, for every work injury. If you intend to dispute the claim, file within fifteen days of notice; you can ask for thirty more days to investigate. After the First Notice, the injured worker is mailed information about the Commission's counselors and mediation.

The CC-Form 1A poster and the employee's notice

Post CC-Form 1A, signed, with your insurer's name and address and the policy's expiration date, in one or more conspicuous places at work. It tells employees to report any injury right away, however slight, to a partner or officer and the person in charge where it happened. Without oral or written notice within thirty days, the claim may be barred.

Claims for an accidental injury are filed within one year, or six months after the last benefits, and death and occupational disease claims within two years.

From field notes to a finished Oklahoma report

Note the date, time and place, when the employee told you, the first aid given, and any care away from the work site or time lost beyond the shift. ReportDraft writes the incident up and keeps fields for what made it reportable, the employee's notice and the First Notice of Injury.

Common mistakes

  • Not reporting an urgent care visit because no shift was missed.
  • Missing the ten-day First Notice.
  • A CC-Form 1A poster without the insurer or expiration date.
  • Not recording when the employee first told you.
  • Disputing a claim after fifteen days without asking for more time.
