Oregon runs its own OSHA program. Its Division 1 rules set how fast deaths, catastrophes, hospital admissions, amputations and eye losses are reported to Oregon OSHA, and require every lost time injury to be investigated. Here is each rule with a link to the official text, and how notes become an Oregon incident report.

  • When the department asks, employers, superintendents, supervisors and employees furnish all pertinent evidence and the names of known witnesses, and those in direct authority preserve and mark for identification the materials, tools or equipment needed for the investigationOAR 437-001-0760 (3) (b)
  • Reporting a work-related injury, illness or fatality does not assign fault, does not prove the violation of an OSHA rule, and does not establish eligibility for workers' compensation or other benefitsOAR 437-001-0704 (1), note

8 hours: fatalities and catastrophes

Work-related deaths are reported to Oregon OSHA in person or by phone within 8 hours of the death or of learning about it, including heart attacks at work and motor vehicle accidents during the shift, when death comes within 30 days. So is a catastrophe: two or more workers killed, or three or more admitted to a hospital or clinic, from one incident. The Salem office is at (503) 378-3272, toll free in Oregon (800) 922-2689.

24 hours: hospital admissions, amputations and eye loss

A single in-patient hospital admission, the loss of an eye, or an amputation or avulsion with bone or cartilage loss is reported within 24 hours. Emergency room treatment alone, or a stay only for observation, is not reportable; being admitted after the emergency room is.

Investigating every lost time injury

Every injury that costs a worker time away from work is investigated to find how to prevent it happening again, and the safeguards or fixes found advisable are put in promptly. If Oregon OSHA investigates, the employer provides the evidence and the names of witnesses and preserves and marks the tools or equipment involved. Reporting an injury does not assign fault.

From notes to an Oregon incident report

Note whether the worker missed work, how it happened and what you changed. ReportDraft marks lost time injuries, records when Oregon OSHA was called, adds the federal Form 301 items Oregon uses, and lists each safeguard or fix as a corrective action.

Common mistakes

  • Treating a hospital admission like a fatality and waiting for the 8-hour window to pass, or the reverse.
  • Skipping the investigation because the injury was only a few days off work.
  • Forgetting that a motor vehicle accident during the shift counts.
  • Reporting an emergency room visit with no admission.
  • Moving or discarding the tool involved before Oregon OSHA is done with it.
