Wyoming employers follow federal OSHA recordkeeping and add the Worker's Compensation Act's reports to the Workers' Compensation Division (W.S. 27-14-502 and 27-14-506): the employee reports within 72 hours, you acknowledge a written report in writing, and you file your own certified report within ten days. Here is each Wyoming rule with a link to the Wyoming Statutes or the Division, and what a Wyoming incident report should record.

What Wyoming requires

  • The injured employee reports the occurrence and general nature of the accident or injury to the employer in writing (or by a means the department approves) as soon as practical and no later than 72 hours after its general nature became apparent, and within ten days files an injury report with the employer and the DivisionW.S. 27-14-502 (a) · Workers' Compensation Division: FAQs (Injured Workers)

  • If the employee does not report to the employer and file the injury report on time, the claim is presumed denied unless the employee shows by clear and convincing evidence that the employer and the Division were not prejudiced in investigating the injury and monitoring treatmentW.S. 27-14-502 (c)
  • When an employee reports an injury, the employer files a certified employer's injury report with the Division within ten days after being notified, with the information the director's rules require, and mails or delivers a copy to the employeeW.S. 27-14-506 (a) · Workers' Compensation Division: Report an Injury
  • The employer states on the report either that the injury is compensable and under the jurisdiction of the Act, or that it is not compensable under the Act and whyW.S. 27-14-506 (a) (i), (ii)
  • An employer's willful failure or gross negligence in reporting injuries to its employees is a misdemeanor punishable by a fine of up to 750 dollars, up to six months in jail, or bothW.S. 27-14-506 (c)
  • Each employer keeps the Division's notice, with a brief summary of the Act and the procedures for filing claims, posted in a conspicuous place for employees, and keeps a copy of the Act available to all employeesW.S. 27-14-507

The employee's report: 72 hours, then 10 days

An injured employee tells you about the accident and the general nature of the injury as soon as practical, and no later than 72 hours after it became apparent. Within ten days the employee files an injury report with you and the Division; the Division asks the worker and employer to complete its Report of Injury form together. When the employee's report is in writing, acknowledge receipt in writing on the report or a copy.

A late report means the claim is presumed denied, unless the employee shows by clear and convincing evidence that the delay did not hurt the investigation or the monitoring of treatment.

Your report to the Division, within 10 days

Within ten days after you are notified of an injury, file a certified employer's injury report with the Division and mail or deliver a copy to the employee. On it, state either that the injury is compensable and under the Act, or that it is not compensable and why.

The poster and the penalty

Keep the Division's notice, which summarizes the Act and how to file a claim, posted where employees see it, and keep a copy of the Act available to them. Willful failure or gross negligence in reporting injuries is a misdemeanor with a fine of up to 750 dollars, up to six months in jail, or both.

From field notes to a finished Wyoming report

Note when the employee reported, the accident's time, place and general nature, and when you acknowledged a written report. ReportDraft writes the incident up and keeps fields for those dates, your report to the Division, the employee's copy and your compensability statement, which it leaves for you to choose.

Common mistakes

  • Not acknowledging the employee's written report in writing.
  • Leaving the compensable or not compensable statement off.
  • Forgetting the employee's copy of your report.
  • Not recording when the employee first reported.
  • No Division notice posted, or no copy of the Act available.
