What West Virginia requires

  • No one may apply pesticides for hire without a pesticide application business license from the Commissioner, issued only after an owner, manager, partner or officer passes the business exam, limited to the classifications for which the business keeps certified commercial applicators, required for each branch office or suboffice, and expiring at the end of the calendar yearW. Va. Code 19-16A-7 (a)-(d)

  • Non-certified employees who apply pesticides register with the Commissioner as registered technicians after completing an approved, verifiable training program taught by a certified applicator within 30 days of starting work; they carry the Commissioner's identification card and show it to anyone who asks, and the business reports a technician's termination in writing within 30 days61 CSR 12A-6.4, 6.4.a, 6.4.d, 6.4.e
  • While a non-certified applicator uses a restricted use product, the certified applicator can reach the point of use within a reasonable time, is reachable at once, gives site-specific instructions, checks the equipment before each day of use and makes sure the labeling and required protective equipment are at hand; label supervision requirements, such as a certified applicator on site, control61 CSR 12A-8.1.b, 8.2, 8.3
  • Each commercial applicator keeps, for at least two years, records of the application of all pesticides with the brand name and EPA registration number, the formulation, dilution rate and quantity used, the time, date and place of application with the name and address of the person for whom it was applied, the pest, the crop, commodity, stored product or site, the size of the area treated, and the name and certification number of the certified and non-certified applicators; the business's records may serve for its certified employees61 CSR 12A-9.1, 9.2

Business licenses, certified applicators and registered technicians

Applying pesticides for hire takes a pesticide application business license, one for each branch office, renewed each calendar year, with bond or liability insurance on file. Everyone who applies for the business, restricted use products or not, is a certified applicator or a registered technician under a certified commercial applicator's direct supervision. Technicians finish an approved training program within 30 days of hire, register, and carry their ID card.

What the application record holds

For every pesticide, record the brand name and EPA number, the formulation, dilution rate and quantity, the time, date and place of application, the customer's name and address, the pest, the site and the size of the area treated, and the name and certification number of both the certified applicator and any non-certified applicator. Keep records two years and send them to the Commissioner on request; failing to can cost the license.

Supervising technicians on restricted use products

Before a technician uses a restricted use product, verify their training record and give site-specific instructions. Stay reachable and able to get to the site in a reasonable time, check equipment before each day of use, and follow any label rule that puts a certified applicator on site.

Equipment and damage claims

Keep equipment leakproof and calibrated with cut-off valves, and use a backflow valve or air gap wherever you mix or load. A customer claiming damage files with the Commissioner within 60 days and must let the damage be examined.

From field notes to a finished West Virginia record

Note the time, each product with its formulation, dilution and quantity, the area size, and who applied it. ReportDraft fills each West Virginia record item and lists the certified applicator and any registered technician with their numbers.

Common mistakes

  • No formulation or dilution rate.
  • No time of application, only the date.
  • A technician's job with only the certified applicator's number.
  • No size of the area treated.
  • Keeping records only for restricted use products.
