Wisconsin's pesticide rules, chapter ATCP 29, set out three pieces of paper for a commercial pest control visit: the business's own record (29.21), the information the customer receives within 30 days (29.22), and, at homes and apartments, a written notice for residents at the time of application (29.55). Here is each rule with a link to the official text.

What Wisconsin requires

  • The record and the customer's copy give the first and last name of each individual who made the application, and the license number of each who made or directly supervised itWis. Admin. Code ATCP 29.21 (2) (a), 29.22 (2)
  • The record gives the month, day, year and approximate starting and ending time of the applicationWis. Admin. Code ATCP 29.21 (2) (e)
  • The record gives the customer's name and address, the site, each pesticide's brand, product or common chemical name and EPA registration number, and either the concentration and total quantity applied or the amount per unit area and total area treatedWis. Admin. Code ATCP 29.21 (2) (b), (c), (f), (g)
  • The record describes the location of the application site specifically enough that it can be readily found from the description, and names any mixing or loading site other than the licensed business location (unless applied straight from a retail container or from equipment holding 5 gallons or 50 pounds or less)Wis. Admin. Code ATCP 29.21 (2) (d), (h)
  • The individual who made the application completes the record the same day; the business keeps it legible for at least 2 years and lets the department inspect and copy itWis. Admin. Code ATCP 29.21 (1)
  • Within 30 days of an application the customer receives in writing (or electronically with written consent) a phone number to reach the business, the names and license numbers, the site and location, the date and times, each product name and EPA number, the concentration and quantity, the label's post-application precautions, and a free label copy or notice that one is free on requestWis. Admin. Code ATCP 29.22
  • The label's post-application precautions reach the customer in time for them to take those precautionsWis. Admin. Code ATCP 29.22 (8)
  • At a residential structure, residents get a written notice at the time of application with the business name, address and phone, each applicator's name and license number, the product, the concentration and quantity, the label's post-application precautions, the date and times, and notice that the label is available on request; a label with a restricted entry interval also needs a warning sign at each entrance to the treated areaWis. Admin. Code ATCP 29.55 (3)
  • Before the first residential application for a customer, and at least yearly under a continuing contract, the business offers in writing to give pre-application information: the products that may be used, their labels, the date, and who to contactWis. Admin. Code ATCP 29.55 (2)

The business record, finished the same day

The person who applied completes the record that day: the first and last name of everyone who applied, the customer's name and address, the site, a location description specific enough to find the spot, the date with approximate start and end times, each product's name and EPA registration number, and either the concentration and total quantity or the amount per area and the area treated. Note any mixing or loading site other than your licensed location. Keep it 2 years.

What the customer receives within 30 days

Within 30 days, in writing or electronically if they agreed in writing, the customer gets a phone number to reach you, the names and license numbers of whoever applied or supervised, the site, location, date and times, each product and EPA number, the amounts, the label's post-application precautions (in time to follow them), and a free label copy or notice that one is free on request.

Homes and apartments

Before the first residential application, and every year on a continuing contract, offer the customer pre-application information in writing. At each residential application, leave residents a written notice with your business details, the applicators and license numbers, the product and amounts, the label's precautions, the date and times, and that the label is available. A label with a restricted entry interval also means a warning sign at each entrance to the treated area.

From the truck to a finished Wisconsin record

Note your start and finish times, exactly where you treated, each product with its concentration and amount, and any precautions the label gives. ReportDraft produces one record that covers the business's file, the customer's 30-day copy and the residents' notice, with the free-label line printed at the end.

Common mistakes

  • Writing the record the next day instead of the day of application.
  • A location like "inside" that nobody could find from the description.
  • No ending time.
  • Leaving residents without a written notice after treating an apartment.
  • Forgetting to say the label is free on request.
