Florida's licensing statute for every provider the Agency for Health Care Administration licenses, section 408.811, sets two clocks after an inspection: a plan of correction, when the Agency asks for one, within 10 calendar days of notification, and the deficiencies themselves corrected within 30 calendar days. Here is what that means for an assisted living facility's plan, with each rule linked to the statute.

What Florida requires

  • When the Agency requires a plan of correction, it is filed within 10 calendar days after notification, unless an alternative timeframe is requireds. 408.811 (5), F.S.
  • Each deficiency is corrected within 30 calendar days after the provider is notified of the inspection results, unless the Agency requires or approves another timeframes. 408.811 (4), F.S.
  • Keep every inspection report as public information for at least 3 years, regardless of a change of ownership, and give a copy of the latest report to applicants, residents and their relatives, spouse or guardian on requests. 408.811 (6), F.S.
  • The Agency has access to all records required during an inspection or review, and the licensee provides copies at no cost to the Agencys. 408.811 (3), F.S.
  • Inspections are unannounced; the Agency, the Department of Children and Families, the Medicaid Fraud Control Unit, the fire marshal and the long-term care ombudsman program may enter an assisted living facility unannounceds. 408.811 (1) (a), F.S. ยท s. 429.34 (1), F.S.
  • An assisted living facility cited for a class I violation, or three or more class II violations within 60 days or in one survey, gets an additional licensure inspection within 6 monthss. 429.34 (2) (a), F.S.

Two deadlines after the inspection

If the Agency requires a plan of correction, it must be filed within 10 calendar days after the facility is notified, unless the Agency sets another timeframe. Separately, each deficiency must be corrected within 30 calendar days of notification, unless the Agency requires or approves a different timeframe, so every line of the plan should end with a completion date inside that window.

What the Agency can see and who can walk in

Inspections are unannounced. For an assisted living facility, the Agency, the Department of Children and Families, the Medicaid Fraud Control Unit, the fire marshal and the long-term care ombudsman program may all enter unannounced. The facility gives the Agency copies of the records it asks for at no cost.

A facility cited for a class I violation, or for three or more class II violations within 60 days or in one survey, gets an additional licensure inspection within 6 months.

After the plan

Inspection reports are public information. The facility keeps them for at least 3 years, even after a change of ownership, and gives a copy of the latest one to anyone who has applied for admission, any resident, and their relatives, spouse or guardian on request.

Common mistakes

  • Treating the 10-day plan deadline and the 30-day correction deadline as the same clock.
  • Giving completion dates past 30 days without the Agency's approval.
  • Naming residents in the plan: use the identifiers the report uses.
  • Not keeping the inspection report on hand to give to families and applicants who ask.
