Nebraska ties move-out cleanliness directly to move-in: the tenant leaves the unit as clean as it was when the tenancy began, ordinary wear and tear excepted. The landlord then has 14 days to send the balance with a written itemization. Here is each rule with a link to the Nebraska Revised Statutes, and how walkthrough notes become the reports that compare the two.

What Nebraska requires

  • Within 14 days after the tenancy ends, the landlord delivers or mails the tenant the balance of the deposit and prepaid rent with a written itemization of anything applied to rent or damages; with no address from the tenant, by first-class mail to the last-known mailing addressNeb. Rev. Stat. s. 76-1416 (2)
  • The deposit and prepaid rent may be applied to rent and to damages the landlord suffered from the tenant's breach of the rental agreement or of the tenant's statutory dutiesNeb. Rev. Stat. s. 76-1416 (2)
  • When the tenancy ends, the tenant leaves the unit in as clean a condition as when the tenancy began, excepting ordinary wear and tear, and during it keeps the space as clean and safe as its condition permits and does not deliberately or negligently damage the premisesNeb. Rev. Stat. s. 76-1421 (2) and (6)
  • If the landlord does not comply, the tenant recovers what is due plus court costs and reasonable attorney's fees; a willful failure not in good faith adds liquidated damages of one month's rent or twice the deposit, whichever is lessNeb. Rev. Stat. s. 76-1416 (3)
  • A pet deposit may not exceed one-fourth of a month's rent, on top of a security deposit of up to one month's rentNeb. Rev. Stat. s. 76-1416 (1)
  • A tenant is not liable for damages directly related to being removed by a government order because the premises were unfit to live in through the landlord's negligence or neglectNeb. Rev. Stat. s. 76-1416 (4)
  • Except in an emergency or where impracticable, the landlord gives at least 24 hours' written notice to each unit, stating the purpose and a reasonable period for the entry, and enters only at reasonable times; the tenant may not unreasonably refuse entry for an inspectionNeb. Rev. Stat. s. 76-1423 (1) and (3)

As clean as when the tenancy began

When the tenancy ends, the tenant places the unit in as clean a condition as when the tenancy began, excepting ordinary wear and tear. During the tenancy the tenant keeps the space as clean and safe as its condition permits and does not deliberately or negligently damage the premises.

That standard only works if the starting condition is on record. A dated move-in report, room by room, is the baseline the move-out report is compared against.

14 days and a written itemization

The deposit and any prepaid rent may cover rent and damages from the tenant's breach of the rental agreement or of the tenant's statutory duties. Within 14 days after the tenancy ends, the landlord delivers or mails the balance with a written itemization of anything kept; if the tenant left no address, it goes by first-class mail to the last-known mailing address.

A landlord who does not comply owes what is due plus court costs and reasonable attorney's fees, and a willful failure not in good faith adds liquidated damages of one month's rent or twice the deposit, whichever is less. A tenant removed by a government order because the landlord let the unit become unfit is not liable for damages directly related to that removal.

Pet deposits and inspections

A pet deposit may not exceed one-fourth of a month's rent. For an inspection during the tenancy, except in an emergency or where impracticable, the landlord gives at least 24 hours' written notice to each unit with the purpose and a reasonable time window, and enters only at reasonable times; the tenant may not unreasonably refuse.

From walkthrough notes to a finished Nebraska report

At move-out, note each room's cleanliness and any damage separately, against how it looked at move-in. ReportDraft writes it up room by room with cleanliness and damage as distinct findings, ready for the 14-day itemization, and leaves lines for the landlord and the tenant to sign.

Common mistakes

  • Holding the deposit past 14 days.
  • Charging cleaning to a tenant who left the unit as clean as it was at move-in.
  • Having no move-in record of how clean the unit was.
  • Taking a pet deposit above one-fourth of a month's rent.
  • Entering for an inspection without 24 hours' written notice stating the purpose and time window.
