The 14-day itemization
Within 14 days after the tenancy ends, deliver or mail the balance of the deposit and prepaid rent with a written itemization of anything applied to rent or damages. Without an address from the tenant, mail it first class to the last-known mailing address.
What may be applied
The deposit may be applied to rent and to damages from the tenant's breach of the rental agreement or of the tenant's statutory duties. The tenant leaves the unit as clean as when the tenancy began, excepting ordinary wear and tear, and does not deliberately or negligently damage the premises.
The penalty
If the landlord does not comply, the tenant recovers what is due plus court costs and reasonable attorney's fees; a willful failure not in good faith adds liquidated damages of one month's rent or twice the deposit, whichever is less.
Deposit limits
A pet deposit may not exceed one-fourth of a month's rent, on top of a security deposit of up to one month's rent.
Common mistakes
- Waiting for a forwarding address instead of mailing to the last-known address.
- Charging to clean beyond the unit's condition at move-in.
- Letting the 14 days pass.
- Holding a pet deposit above one-fourth of a month's rent.
