30 days, with interest

Return the deposit, with any interest due, within 30 days after the tenancy ends.

The itemized list and its evidence

Deductions for damage come with a written, itemized list stating with particularity the repair needed for each item, and satisfactory evidence that the repairs have been or will be done, such as receipts for materials and labor estimates, bills or invoices. Repair costs may be deducted only for damage beyond reasonable wear and tear.

Receipts and records

A deposit not paid by check gets a signed receipt stating the amount and where it is held. On request, the landlord tells the tenant where the deposit is held, the account number, the amount and the interest rate, and lets the tenant examine their deposit records.

Common mistakes

  • Listing damage without the repair needed for each item.
  • Leaving out the receipts, estimates, bills or invoices.
  • Forgetting interest that is due.
  • Charging reasonable wear and tear.
