A Michigan seller of a home with 1 to 4 units gives the buyer a Seller's Disclosure Statement, on the form the Seller Disclosure Act prescribes, before the seller signs a binding purchase agreement: appliances and systems, property conditions, other matters such as easements, assessments and litigation, and the buyer advisories. Here is each rule with a link to the statute.

  • In a sale, the seller delivers the signed statement to the buyer or the buyer's agent (or through the seller's agent, who gives the buyer a copy) before the seller executes a binding purchase agreementMCL 565.954 (1)
  • The seller indicates compliance with the Act on the purchase agreement, contract, lease, an addendum or a separate documentMCL 565.954 (2)
  • If the statement or an amendment arrives after the seller signed a binding purchase agreement, the buyer may terminate by written notice within 72 hours after in-person delivery, or 120 hours after delivery by registered mail, until the property is transferredMCL 565.954 (3) and (4)
  • Exempt transfers include court-ordered and foreclosure transfers, transfers to a defaulting mortgagor's lender, by a nonoccupant fiduciary, between co-tenants, to a spouse, parent, grandparent, child or grandchild, on divorce, to or from a government, and never-inhabited new homes sold by a licensed builderMCL 565.953

Which transfers need the statement

The Act covers sales, exchanges, installment land contracts, leases or other options to purchase, ground leases with improvements and cooperative interests in property with 1 to 4 homes. Court-ordered and foreclosure transfers, transfers by a nonoccupant fiduciary, between co-tenants, to close family, on divorce, to or from a government and never-inhabited new homes from a licensed builder are exempt.

Completing the form

The seller answers every question on the statutory form, in good faith: Yes, No, Unknown when the seller does not know the facts, or Not Available when an item does not apply. The seller is not liable for what was outside the seller's personal knowledge or could only be found by inspecting inaccessible areas or by an expert.

Delivery and the buyer's right to terminate

The statement reaches the buyer, the buyer's agent or the seller's agent (who passes on a copy) before the seller signs a binding purchase agreement, and compliance is noted on the agreement, an addendum or a separate document.

If it arrives after the agreement is signed, the buyer may terminate by written notice within 72 hours after in-person delivery, or 120 hours after delivery by registered mail. The right ends when the property is transferred.

Common mistakes

  • Signing the purchase agreement before the buyer has the statement, which opens a 72-hour or 120-hour right to walk away.
  • Leaving questions blank instead of checking Unknown or Not Available.
  • Forgetting to note compliance with the Act on the purchase agreement or an addendum.
  • Dropping the buyer advisories at the end of the form.
