  • An owner who learns, before acceptance, of anything that would change an answer submits a complete amended report or an amendment within the time for the reportWis. Stat. s. 709.035
  • A buyer who receives the report after submitting the contract may rescind in writing within 2 business days after receipt if it discloses a defect the buyer did not know of; an incomplete report also allows rescission within 2 business days; the right can be waived in writing and ends at closingWis. Stat. s. 709.05 ยท Wis. Stat. s. 709.08
  • The owner indicates compliance with chapter 709 on the contract of sale or option contract, the closing statement or an addendumWis. Stat. s. 709.04

  • Each disclosure is made with honesty in fact; the owner is not liable for errors the owner did not know of, or based on information from a public agency or a licensed professionalWis. Stat. s. 709.06 and 709.07

Who fills it in

Owners selling, exchanging or land-contracting property with 1 to 4 dwelling units, condominium units and time-shares complete the report. Transfers exempt from the real estate transfer fee, never-inhabited homes, and court-supervised fiduciaries who never lived there are outside it.

Completing the report

Every question is answered yes, no or N/A, and each yes is explained in that section's additional information space; a report is complete only when every item is answered. The examples under each question are not the only defects to disclose. A condominium sale also needs the addendum describing the condominium and its association.

Deadlines and the buyer's right to rescind

The report reaches the buyer within 10 days after the contract is accepted. If it does not, the buyer may rescind within 2 business days after those 10 days. A buyer who gets the report after submitting the contract may rescind within 2 business days of receipt if it discloses a defect the buyer did not know about. The buyer can waive the right in writing, and it ends at closing. Compliance is noted on the contract, the closing statement or an addendum.

Common mistakes

  • Answering yes without the explanation the form requires.
  • Leaving an item blank, which makes the report incomplete and opens a 2-business-day rescission.
  • Forgetting the condominium addendum when selling a condominium unit.
  • Missing the 10-day deadline after acceptance.
