  • No one may engage in the business of applying pesticides to the lands or personal property of another without a license from the Department, and a license is issued and stays valid only while the business is certified or employs a certified applicator at all times, at least one with two years' practical experience under a certified applicator within the previous three years3 Del. C. 1206 (a), 1207 (c) (1)
  • Business licenses (50 dollars a year or 100 dollars for two years) end December 31 of the year they expire unless renewed; a renewal filed after January 1 carries a 20 percent penalty, and the license is revoked if the business no longer employs a certified applicator with two years' practical experience3 Del. C. 1207 (b), (e), 1209 (b) (3), 1210
  • Noncertified individuals employed by licensees are registered with the Department as registered service employees, and restricted use pesticides are used only by certified applicators or people under a certified applicator's direct supervision; applicants for certification are at least 183 Del. C. 1212 (a) ยท 3 Del. C. 1216
  • Commercial applicators keep records of every pesticide application with the brand name (and the EPA registration number, recorded at or before the application, for a restricted use pesticide or one used under the Worker Protection Standard), the dilution rate and the amount of diluted material applied per unit when applicable, the date and specific area treated with the name and address of the person for whom it was applied, the pest, and the crop, commodity or site with the size of the treatment area3 DE Admin. Code 601, ss. 14.1.1-14.1.4 (amended 26 DE Reg. 1050, 06/01/23)
  • When the label advises precautions about drift, the record gives the on-site weather: wind velocity and direction, temperature and relative humidity3 DE Admin. Code 601, s. 14.1.6
  • Unless good cause is shown, the record is logged immediately or within 24 hours of finishing the application, and kept for two years from the date of application3 DE Admin. Code 601, ss. 14.1, 14.1.8
  • The applicator has a copy of the label of the pesticide being used at the application site, and on request gives any interested person at or next to the site any information on the label3 DE Admin. Code 601, s. 14.1.7
  • Direct supervision of a noncertified applicator follows 40 CFR 171.201; where the certified applicator need not be physically present it includes verifiable instructions to the person: detailed guidance for applying the pesticide properly and a way to contact the certified applicator, and the certified applicator is physically present when the label requires3 DE Admin. Code 601, ss. 10.1, 10.3
  • Structural and turf pest control businesses show their pest control business license number in bold readable numbers 2 to 6 inches high and the business licensee's full name on every service vehicle3 DE Admin. Code 601, s. 5.5
  • Every soil termiticide application is made with a commercial applicator certified in Wood Destroying Pest Control (7B) at the site, at no less than the label's minimum concentration and volume to form a continuous chemical barrier, and pre-construction treatments follow the label and EPA PR Notice 96-73 DE Admin. Code 601, ss. 22.3, 22.4, 22.6 (amended through 28 DE Reg. 576, 02/01/25)
  • A termite job that uses less than the label volume or leaves out labeled areas (because of a well, footing drain or high water table, structural or soil barriers, or the customer's request or applicator's recommendation) needs a written disclosure to the customer within 14 days on the Department's approved form: the difference between full and partial treatment with the strategy and reasons, the brand name and EPA number, the actual volume applied, a diagram of the structure with treated areas, known well heads and sites of visible termite activity, and whether there is a guarantee or warranty and its terms; copies are kept two years3 DE Admin. Code 601, s. 22.3.1-22.3.2
