What Kansas requires
- A pesticide business may not advertise, sell or perform pest control or apply pesticides to another's property without a pesticide business license from the Secretary of Agriculture, by category, expiring at the end of the calendar year; it reports each uncertified individual it employs to apply pesticides within 30 days of hiring and keeps a certified commercial applicator in each category it works inK.S.A. 2-2440 (a)-(c) ยท K.S.A. 2-2450 (b)
- Each customer gets a statement of services or contract with the business's name, address and license number, the customer's name and address, the pests, each pesticide with the quantity applied and total area, the concentration or rate, the date, location and start and end times, the expiration date of any guarantee, the signature and applicator certification number of the individual who performed the service and of any supervisor, the wind direction and velocity when applicable, and a note when the application was less than the label rateK.S.A. 2-2455 (a)
- The statement gives the start and end time of the applicationK.S.A. 2-2455 (a) (6)
- The statement carries the signature and applicator certification number of the individual who performed the service, and of the individual who supervised it when applicable; legible printed names may serve as the signaturesK.S.A. 2-2455 (a) (8)-(9), (c) (6)
- For termites, powder-post beetles, wood borers, wood-rot fungus or other wood destroying pests, the statement adds the conditions for any retreatments, the approximate dates of later inspections, and a diagram of the structure showing visible evidence of active and inactive infestation and, for a partial or spot treatment, the areas to be treatedK.S.A. 2-2455 (b)
- The statement goes to the customer on paper (or electronically if the customer agrees) within 30 days of the service and before payment is due, or by the close of the next business day if the customer asks; the business keeps a copy for three years from the statement's expiration, gives the Secretary a duplicate within two business days on request, and carries out what the statement promisesK.S.A. 2-2455 (c) (2)-(8)
- Unless the label prohibits it, an applicator may apply a pesticide at any dosage, concentration or frequency lower than the label states, and the customer's statement then says the application was less than the label rateK.S.A. 2-2470 (1)
- A pesticide business license needs a surety bond of at least 6,000 dollars a year or liability insurance of at least 25,000 dollars bodily injury and 5,000 dollars property damage per occurrence; the license is suspended if coverage lapses, and 'bond' or 'bonded' may be advertised only for a performance bond with its amount statedK.S.A. 2-2448 (a)
- Each licensee gives the Secretary on request its statements of services, records of all pesticide applications for any period and records of every employee who worked on pesticide applications, and creates or verifies records of each uncertified applicator's qualificationsK.S.A. 2-2455 (d), (f)
Business licenses and certified applicators
A pest control business needs a pesticide business license for each category it works in, renewed each calendar year, a certified commercial applicator in each of those categories, and a bond or liability insurance on file. Report each uncertified employee who applies pesticides within 30 days of hiring.
The customer's statement of services
Every customer gets a statement with your business name, address and license number, the customer's name and address, the pests, each product with the quantity and total area, the concentration or rate, the date, location and start and end times, any guarantee's expiration date, the wind direction and velocity when it matters, and the signature and certification number of the person who did the work and of any supervisor. Printed names can stand in for signatures.
Below-label rates
Kansas lets you apply below the label's dosage, concentration or frequency unless the label forbids it, but the statement must say the application was less than label rate.
Termites and other wood destroying pests
Wood destroying pest jobs add the conditions for any retreatment, the approximate dates of later inspections, and a diagram of the structure showing active and inactive infestation, plus the areas treated in a partial or spot treatment.
Delivery and keeping copies
Give the statement within 30 days of the service and before payment is due, or by the next business day if the customer asks. Keep a copy three years from its expiration, and give the Department a duplicate within two business days when asked, along with application and employee records.
From field notes to a finished Kansas statement
Note your start and end times, each product with its quantity, rate and area, the wind for outdoor work, and who did and supervised the job. ReportDraft lays out every K.S.A. 2-2455 item, prints signature lines for both people, and adds the termite terms when the job calls for them.
Common mistakes
- No end time, only a start time.
- No total area treated.
- A supervised job without the supervisor's certification number.
- A below-label application not marked as less than label rate.
- A termite treatment without the diagram or retreatment conditions.
