Montana licenses commercial pesticide applicators under the Montana Pesticides Act (MCA 80-8-203), and the Department of Agriculture's rule ARM 4.10.207, amended in January 2025, lists what every application record holds and when it is due: within 24 hours, kept two years. Here is each rule with a link to the official text, and what a Montana pest control service record should contain.

What Montana requires

  • It is unlawful to engage in the business of applying pesticides for another without a pesticide applicator's license from the Department of Agriculture, and the applicator is responsible for the use of any pesticide by an operator or employee under their supervisionMCA 80-8-203 (1), (4)
  • Every application record includes the name and certification number of the certified applicator who made or supervised it and any operator who made it, the date, start and end times, the property owner's or lessee's name and address and the specific site, the equipment, each pesticide's company name, trade name and EPA registration number, the rate of application, the area treated or type of structural treatment, the pests, the site treated, and the weather if applicableARM 4.10.207 (2) (amended eff. 2025-01-25)
  • The record gives the time of application, including both start and end timesARM 4.10.207 (2) (c)
  • The record lists the equipment used; equipment used for every application may be listed once, or numbered and listed once by descriptionARM 4.10.207 (2) (e)
  • Applicators record application information daily, not more than 24 hours from the time of application, and record all required data for each pesticide in a tank mixARM 4.10.207 (3), (4)
  • Commercial applicators and their operators keep application records for two years, open to the Department's inspection during business hours; on written request the records go to the Department within 14 calendar days, and a period with no applications must be documentedARM 4.10.207 (1), (5), (8)
  • Employees of certified applicators who apply pesticides become licensed operators under direct supervision; operators use only the pesticides their supervising applicator is qualified for, within 100 miles of the applicator, and one certified applicator or licensed operator is required for each spraying unit in operationARM 4.10.206 (1), (2)
  • Before applying an EPA restricted use pesticide, the applicator notifies the owner, lessee or manager of the property of all precautions and restrictions, and provides a copy of the label if askedARM 4.10.209
  • Applicator records held by the Department are subject to public disclosure unless the Department finds the applicator's right to privacy clearly outweighs the public's right to knowARM 4.10.207 (7)

Applicator licenses and operators

You need a pesticide applicator's license to apply pesticides for others, and you are responsible for what your operators and employees apply. Operators are licensed, work under direct supervision within 100 miles of the applicator, and use only the pesticides the applicator is qualified for.

What every application record holds

Record the certified applicator's name and certification number and any operator who applied it, the date with start and end times, the owner's or lessee's name and address and the specific site, the equipment, each product's company name, trade name and EPA number, the rate, the area treated or type of structural treatment, the pests, and the weather if applicable. Each product in a tank mix gets its own full entry.

Within 24 hours, kept two years

Write the record within 24 hours. Keep records two years and open to the Department during business hours; on a written request, send them within 14 calendar days, and document any period with no applications. Records held by the Department can be public.

Restricted use pesticides

Before applying a restricted use pesticide, tell the owner, lessee or manager about all precautions and restrictions, and give them a copy of the label if they ask.

From field notes to a finished Montana record

Note when you started and finished, the equipment, each product with its maker, EPA number and rate, and the area treated. ReportDraft puts the times, equipment, certification number and any operator in the header and lays out each product with the company and trade name the rule asks for.

Common mistakes

  • No end time, only a start time.
  • A trade name without the company name.
  • No equipment listed.
  • One line for a tank mix instead of one entry per product.
  • Writing the record days later instead of within 24 hours.
