At move-in
On move-in, the landlord gives the tenant a signed copy of the lease and a move-in form for specifying any existing damage to the unit, together with written notice that the tenant may be present at the move-out inspection.
If the tenant asks, the landlord tells the tenant when the move-out inspection will take place.
After move-out
Within 14 days, not counting Saturdays, Sundays or legal holidays, after the tenancy ends, possession is returned and the tenant asks for it, the landlord gives the tenant an itemized list of all deductions with any amount due, by first class mail to the tenant's last known residence unless the tenant arranged otherwise in writing.
If the tenant does not dispute the deductions within 60 days after the list is mailed, it is final. A landlord who does not follow these rules can owe the money due plus damages of twice the amount wrongfully withheld.
What deductions rest on
Deductions for damage rest on the tenant's duties, which include keeping their part of the premises as clean and safe as its condition permits, keeping plumbing fixtures as clean as their condition permits, and not deliberately or negligently damaging any part of the premises. A clear move-in record shows what was already there.
The purpose of every nonrefundable fee or deposit is stated in writing; anything not designated nonrefundable is refundable.
From walkthrough notes to a finished Arizona move-in form
Walk the unit room by room and note every item of existing damage. ReportDraft writes the notes up as a room-by-room move-in form with each item marked and the damage described.
On a move-in report, ReportDraft prints a notice to the tenant that they may be present at the move-out inspection and can ask when it will take place, followed by signature lines for the landlord and the tenant.
Common mistakes
- Not giving the tenant a move-in form for recording existing damage.
- Forgetting the written notice that the tenant may attend the move-out inspection.
- Not telling the tenant when the move-out inspection is, after they asked.
- Missing the 14 business day deadline for the itemized list of deductions.
- Calling a fee nonrefundable without stating its purpose in writing.
