Move-in: the 5-day list
The landlord gives the tenant written notice that a written list of conditions in need of repair or correction, if any, should be given to the landlord within 5 days of occupancy.
When a deposit is not paid by check, the landlord also gives a signed receipt stating the amount and where it is held, with the same notice.
Move-out: return and deductions
The landlord returns the deposit, with any interest due, within 30 days after the tenancy ends. Repair costs may be deducted only for damage beyond reasonable wear and tear.
Deductions come with a written, itemized list stating with particularity the repair needed for each item, and satisfactory evidence that the repairs have been or will be done, such as receipts, estimates, bills or invoices. On request, the landlord shows the tenant where the deposit is held and lets them examine the records.
From walkthrough notes to a finished New Hampshire record
Walk the unit room by room before move-in and note each item, with photos. On a move-in report, ReportDraft prints the notice about the tenant's 5-day list of conditions needing repair, followed by signature lines for the landlord and the tenant.
At move-out, a report on the same rooms and items shows what changed, which is the basis for describing each repair with particularity.
Common mistakes
- Not telling the tenant in writing about the 5-day list of conditions needing repair.
- Giving a cash deposit receipt without the place the deposit is held.
- Itemizing deductions without saying what repair each item needs.
- Deducting without receipts, estimates, bills or invoices as evidence.
- Missing the 30-day deadline.
