What Oklahoma requires
- Deductions for accrued rent and damages are itemized in a written statement delivered by return-receipt mail, signed for at the address, or in person; the balance of the deposit goes back within 45 days after the tenancy ends, possession is delivered and the tenant makes a written demand41 O.S. s. 115 (B) (Oklahoma Statutes, Title 41) ยท 41 O.S. s. 115 (B) (Title 41, text edition)
- The deposit may be applied to accrued rent and to the damages the landlord suffered because the tenant did not comply with the Residential Landlord and Tenant Act and the rental agreement; unless the agreement allows it, the tenant may not use the deposit as the last month's rent41 O.S. s. 115 (B), (F)
- A tenant who makes no written demand for the deposit within six months after the tenancy ends loses it: the deposit reverts to the landlord for the cost of keeping the escrow account41 O.S. s. 115 (B)
- If the landlord or manager does not comply with the deposit section, the tenant may recover the deposit and any prepaid rent; the deposit is kept in an escrow account with a federally insured institution in Oklahoma, and misappropriating it is a crime41 O.S. s. 115 (A), (E)
- Throughout the tenancy the tenant keeps the part of the premises they use as safe, clean and sanitary as its condition permits, disposes of waste safely, keeps plumbing fixtures clean and sanitary, uses electrical, plumbing, heating, cooling and other facilities and appliances in a safe and nondestructive way, and does not deliberately or negligently damage or remove any part of the premises or let any person, animal or pet do so41 O.S. s. 127
- A defective condition the tenant notices and believes the landlord does not know about is reported to the landlord as soon as practicable41 O.S. s. 125
- The tenant may not unreasonably withhold consent to the landlord entering to inspect; except in an emergency or where impracticable, the landlord gives at least one day's notice of the intent to enter and enters only at reasonable times, and may not abuse access or use it to harass41 O.S. s. 128 (A), (C)
- The rental agreement names, prominently and in writing, the person and address for service and notices, and at or before the start of the tenancy the landlord discloses in writing the name and address of the manager and of the owner or an agent for notices41 O.S. s. 116 (A)
What the deposit can cover
The deposit may be applied to accrued rent and to damages the landlord suffered because the tenant did not comply with the Act and the rental agreement. The tenant's duties are listed: keep the premises they use safe, clean and sanitary, dispose of waste safely, keep plumbing fixtures clean, use appliances and facilities in a safe and nondestructive way, and not damage the premises or let any person, animal or pet do so.
A move-out report that names which duty each item of damage falls under, read against a dated move-in report, is the backbone of the written statement.
The written statement, the demand and 45 days
Deductions are itemized in a written statement delivered by return-receipt mail, signed for at the address, or in person if the tenant can reasonably be found. The balance goes back within 45 days after the tenancy ends, possession is delivered and the tenant makes a written demand.
A tenant who makes no written demand within six months loses the deposit to the landlord. A landlord who does not comply with the section can be made to return the deposit and any prepaid rent. The deposit is held in an escrow account in Oklahoma, and unless the agreement says otherwise the tenant cannot treat it as the last month's rent.
Inspections during the tenancy
The tenant may not unreasonably refuse the landlord entry to inspect. Except in an emergency or where impracticable, the landlord gives at least one day's notice of the intent to enter and enters only at reasonable times, and may not use access to harass. A tenant who notices a defect they believe the landlord does not know about reports it as soon as practicable, and a routine inspection report dates what was found.
From walkthrough notes to a finished Oklahoma report
At move-in, note each room and its condition, along with the person and address for notices named in the rental agreement. At move-out, walk the same rooms. ReportDraft writes each up room by room, describes each item of damage plainly enough for the itemized statement, keeps ordinary aging apart from damage, notes pet damage when your notes say so, and leaves lines for the landlord and the tenant to sign.
Common mistakes
- Sending the itemized statement by ordinary mail instead of return-receipt mail or in person.
- Missing the 45 days after the tenant's written demand.
- Deducting for something that is not unpaid rent or damage from a breach of the tenant's duties or the agreement.
- Entering without at least one day's notice outside an emergency.
- Having no move-in record to show the condition the tenant received.
