  • If the tenant does not dispute the deductions within 60 days after the itemized list is mailed, the list is final and further claims by the tenant are waivedArizona Revised Statutes s. 33-1321 (D)
  • A landlord who does not follow the itemized-list rules can owe the tenant the money due plus damages of twice the amount wrongfully withheldArizona Revised Statutes s. 33-1321 (E)
  • Deductions for damage rest on the tenant's duties, which include keeping their part of the premises as clean and safe as its condition permits, keeping plumbing fixtures as clean as their condition permits, and not deliberately or negligently damaging any part of the premisesArizona Revised Statutes s. 33-1341
  • The landlord states in writing the purpose of every nonrefundable fee or deposit; anything not designated nonrefundable is refundableArizona Revised Statutes s. 33-1321 (B)

The 14-day itemized list

Within 14 days, not counting Saturdays, Sundays or legal holidays, after the tenancy ends, possession is returned and the tenant asks for the deposit, give the tenant an itemized list of all deductions with any amount due, by first class mail to their last known residence unless the tenant arranged otherwise in writing.

The 60-day window to dispute

If the tenant does not dispute the deductions within 60 days after the itemized list is mailed, the list is final and further claims by the tenant are waived.

What deductions rest on

Deductions for damage rest on the tenant's duties, which include keeping their part of the premises as clean and safe as its condition permits, keeping plumbing fixtures as clean as their condition permits, and not deliberately or negligently damaging the premises. Every nonrefundable fee or deposit has its purpose stated in writing; anything not designated nonrefundable is refundable.

The penalty

A landlord who does not follow the itemized-list rules can owe the tenant the money due plus damages of twice the amount wrongfully withheld.

Common mistakes

  • Counting calendar days instead of leaving out weekends and legal holidays.
  • Emailing the list when the tenant never agreed in writing to anything but mail.
  • Keeping a fee as nonrefundable when the lease never designated it in writing.
  • Missing that the count waits for the tenant to ask for the deposit.
