What Oklahoma requires
- Deductions for accrued rent and damages are itemized in a written statement delivered by return-receipt mail, signed for at the address, or in person; the balance of the deposit goes back within 45 days after the tenancy ends, possession is delivered and the tenant makes a written demand41 O.S. s. 115 (B) (Oklahoma Statutes, Title 41) ยท 41 O.S. s. 115 (B) (Title 41, text edition)
- The deposit may be applied to accrued rent and to the damages the landlord suffered because the tenant did not comply with the Residential Landlord and Tenant Act and the rental agreement; unless the agreement allows it, the tenant may not use the deposit as the last month's rent41 O.S. s. 115 (B), (F)
- A tenant who makes no written demand for the deposit within six months after the tenancy ends loses it: the deposit reverts to the landlord for the cost of keeping the escrow account41 O.S. s. 115 (B)
- If the landlord or manager does not comply with the deposit section, the tenant may recover the deposit and any prepaid rent; the deposit is kept in an escrow account with a federally insured institution in Oklahoma, and misappropriating it is a crime41 O.S. s. 115 (A), (E)
- The tenant may not unreasonably withhold consent to the landlord entering to inspect; except in an emergency or where impracticable, the landlord gives at least one day's notice of the intent to enter and enters only at reasonable times, and may not abuse access or use it to harass41 O.S. s. 128 (A), (C)
The statement and the 45 days
Deductions for accrued rent and damages are itemized in a written statement delivered by return-receipt mail, signed for at the address, or in person. The balance goes back within 45 days after the tenancy ends, possession is delivered and the tenant makes a written demand.
What the deposit covers
The deposit may be applied to accrued rent and to damages from the tenant not complying with the Residential Landlord and Tenant Act and the rental agreement. Unless the agreement allows it, the tenant may not use the deposit as the last month's rent.
The written demand and the escrow account
A tenant who makes no written demand within six months after the tenancy ends loses the deposit. The deposit is kept in an escrow account with a federally insured institution in Oklahoma, misappropriating it is a crime, and a tenant may recover the deposit and prepaid rent if the landlord does not comply.
Entering to inspect
Except in an emergency or where impracticable, the landlord gives at least one day's notice of the intent to enter and enters only at reasonable times.
Common mistakes
- Sending the statement by ordinary mail instead of return-receipt mail or in person.
- Letting the deposit stand in for last month's rent when the agreement does not allow it.
- Keeping deposits outside an escrow account in an Oklahoma institution.
- Entering for the move-out inspection without a day's notice.
