The 45-day disposition statement

After the move-out inspection, give the tenant a written security deposit disposition statement with an itemized list of damages, within 45 days after the tenancy ends or the tenant moves out, whichever is later.

Reasonable wear and tear

The deposit may be applied to damage the landlord suffered from the tenant not meeting their obligations, less reasonable wear and tear.

Move-in and move-out reports

Within five days after the tenant moves in, the landlord gives a written report itemizing the damage that exists at the start. If the landlord finds more damage after the deposit disposition, the tenant may use a copy of the move-out report as evidence that it was not there at the move-out inspection.

Two years of records

Keep itemized records of every deduction from each tenant's deposit for the preceding two years, and let the tenant inspect them during normal business hours.

Common mistakes

  • Counting 45 days from the lease end when the tenant moved out later.
  • Charging reasonable wear and tear as damage.
  • Finding damage after the statement is sent and adding it without checking the move-out report.
  • Not keeping the itemized deduction records for two years.
