Kentucky rules for this report

These rules are about how and when you report, not the template's fields. Check them before you deliver.

  • A contractor, or anyone representing one, may not represent or negotiate, or advertise to, as a public adjuster or otherwise, for an insured on any insurance claim for goods or services relating to real estate, or market itself, its staff or business as a claims or insurance specialist or expert or as affiliated with an insurer. It may give an estimate and confer with the insurer's representative about the damage after the insured has submitted a claimKRS 367.628 (1)
  • Before entering a contract for real estate goods or services expected to be paid from insurance, the contractor gives the person its mailing address, phone number (and fax and email if any), two notices in at least 10-point bold type (the right to cancel within five business days of an insurer's written notice that the work is not covered, and that the contract may not assign the insured's policy rights or benefits), and a completed NOTICE OF CANCELLATION form in duplicate, attached but easily detachableKRS 367.624
  • A person who signs a contract for goods or services relating to real estate that are expected to be paid from insurance may cancel it before midnight of the fifth business day after receiving the insurer's written notice that all or part of the claim is not a covered loss, by delivering, mailing, faxing or emailing a written notice in any formKRS 367.622 · KRS 367.620
  • Except for emergency goods or services, a contractor may not require advance payments until the cancellation period has run, returns payments and notes within ten days of a cancellation, and cannot enforce a canceled contract or one priced in violation of the state of emergency price law, or collect a cancellation fee on it; emergency work and repairs done to prevent further damage may still be charged at a reasonable and customary amountKRS 367.626
  • Where insurance is expected to pay, a contractor may not cause or encourage damage to the property to win the job or enlarge it (also a fraudulent insurance act and first-degree criminal mischief), offer to pay or rebate the deductible or claim proceeds, discount its fee, give the insured more than 100 dollars in any bonus, gift, credit, referral fee or other item of value, be financially connected to a public adjuster or appraiser, solicit contracts for them, or file a mechanic's lien for charges above what the insurer paysKRS 367.628 (2), (3)
  • An insured under a property, casualty, or property and casualty policy may not assign or transfer, before or after a loss, its duties or its rights or benefits under the policy (claim payments included), and a contract that does is void; the insured may still authorize or direct payment to a person for covered services or materialsKRS 304.20-105
  • When a declared state of emergency follows destruction to real estate, the Attorney General may order roofing and siding contractors (and water damage and tree or debris removal contractors) working in the designated area to register; a registered contractor shows its certificate on request, posts it at each job site, and gives proof of registration to the insured and the insurer with any direction of payment on a claim. For 90 days after the declaration, these contractors may not solicit in person in the area without the owner's prior approval, though advertising and phone or digital contact are allowedKRS 367.379 (2026 Ky. Acts ch. 54, effective July 15, 2026)
  • The Attorney General enforces these rules; a court can order an injunction, twice the actual economic damages and attorney's fees for an injured person, and a civil penalty of 5,000 dollars per violation, and a contract provision representing the insured on the claim is unenforceableKRS 367.627 · KRS 367.628 (1) (b)
